1. Acceptance of Terms

By accessing, browsing, or using Nonograms Club (available at nonograms.club), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the platform. Your continued use of Nonograms Club after any modifications to these Terms constitutes acceptance of those changes.

2. Eligibility

To use Nonograms Club, you must:

  • Be at least 16 years of age.
  • Have the legal capacity to enter into a binding agreement.
  • Not be prohibited from using the service under applicable laws.

By creating an account, you represent and warrant that you meet all eligibility requirements. If you are using the service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Description of Service

Nonograms Club is a curated web directory platform where users can:

  • Submit websites for inclusion in the directory (free or premium listings).
  • Receive a dofollow backlink from nonograms.club for approved premium listings.
  • Vote on, review, and discover listed websites.
  • Earn engagement points, climb tiers, and appear on leaderboards through our gamification system.
  • Access a weekly digest newsletter featuring top listings and community activity.

Free listings receive a nofollow link. Premium (paid) listings receive a DR 10 dofollow backlink, subject to approval and compliance with these Terms.

4. Account Registration and Security

  • Accurate information: You must provide truthful and accurate information when creating your account. You agree to keep your account information up to date.
  • One account per person: You may only create and maintain one account. Creating multiple accounts is prohibited and may result in termination of all accounts.
  • Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
  • Authentication methods: You may register using email/password credentials or via OAuth providers (Google, GitHub, Discord, Microsoft, Twitter/X, LinkedIn, Facebook, Apple). Using OAuth grants us access only to the basic profile information (name, email, avatar) authorised during the OAuth flow.

5. Listing Submissions

  • You may only submit websites that you own or are authorised to submit on behalf of the owner.
  • Submitted websites must be live, functional, and contain genuine content at the time of submission and review.
  • You must select an appropriate category and provide an accurate description of the website.
  • Screenshots and logos must accurately represent the submitted website.
  • We reserve the right to reject, edit, reclassify, or remove any listing at our sole discretion, without obligation to provide a reason.
  • Submitting a listing does not guarantee approval. All submissions are reviewed by our team before publication.

6. Prohibited Content

You may not submit websites or content that contains, promotes, or facilitates:

  • Illegal activities or services in any jurisdiction
  • Malware, viruses, phishing, or other malicious software
  • Spam, auto-generated, or scraped content with no original value
  • Adult, pornographic, or sexually explicit material
  • Hate speech, discrimination, or incitement to violence
  • Harassment, doxxing, or invasion of privacy
  • Intellectual property infringement (copyright, trademark)
  • Deceptive practices, scams, or fraudulent schemes
  • Illegal drugs, weapons, or controlled substances
  • Gambling (unless legally licensed and disclosed)
  • Parked domains, domains for sale, or redirect-only pages

Submitting prohibited content will result in immediate rejection of the listing and may result in permanent account termination without refund.

7. Payment Terms

  • One-time payment: Premium listings require a one-time fee. There are no recurring subscriptions or hidden charges for directory listings.
  • Current pricing: Pricing is displayed on the submission page at the time of purchase. Your payment locks in the price at the time of transaction. Prices may change without notice, but changes do not affect prior purchases.
  • Payment processors: Payments are processed by third-party providers (Stripe, PayPal, Dodo Payments, LemonSqueezy). By making a payment, you also agree to the respective processor's terms of service.
  • Refund policy:
    • Refunds may be issued within 7 days of payment if your listing has not yet been approved.
    • Once a listing is approved and the backlink is live, the payment is non-refundable.
    • If we are unable to fulfil the service (e.g., site is permanently down, we discontinue the service), we will issue a full refund.
    • Refund requests must be submitted via the Contact page.
  • EU Right of Withdrawal: Under EU consumer protection law, you have a 14-day right of withdrawal for online purchases. However, by requesting immediate processing of your listing submission at checkout, you acknowledge and consent that the right of withdrawal may be lost once the digital service has been fully performed (i.e., once your listing is approved and published), in accordance with Article 16(a) of the Consumer Rights Directive (2011/83/EU).
  • Taxes: You are responsible for any applicable taxes. Prices displayed may not include VAT or other taxes depending on your jurisdiction.

9. Gamification System

  • Nonograms Club features a gamification system including points, tiers, badges, streaks, and leaderboards. These are designed to encourage genuine engagement with the platform.
  • Points, tiers, and leaderboard positions are non-transferable and have no monetary value. They cannot be exchanged, sold, or redeemed for cash or any other consideration.
  • We reserve the right to modify, reset, recalculate, or discontinue the gamification system (in whole or in part) at any time, without prior notice and without liability.
  • Manipulation of the gamification system (automated voting, coordinated abuse, fake reviews for points) will result in point forfeiture and potential account termination.

10. Prohibited Conduct

You agree not to engage in any of the following activities:

  • Vote manipulation: Using bots, scripts, multiple accounts, or coordinated groups to artificially inflate or deflate votes on any listing.
  • Fake reviews: Posting false, misleading, defamatory, or paid-for reviews without disclosure.
  • Multiple accounts: Creating more than one account per person to circumvent rules, gain extra points, or manipulate the system.
  • Scraping and harvesting: Using automated tools to scrape, crawl, or harvest data from the platform without our express written permission.
  • Unauthorised access: Attempting to access accounts, systems, databases, or data that you are not authorised to access.
  • Service disruption: Engaging in any activity that disrupts, overloads, or interferes with the normal operation of the platform.
  • Impersonation: Misrepresenting your identity or falsely claiming affiliation with any person or organisation.
  • Spam: Sending unsolicited messages, posting repetitive content, or engaging in any form of spam through the platform.
  • Circumvention: Attempting to bypass any security measures, rate limits, or restrictions on the platform.

Violation of these rules may result in immediate account termination, forfeiture of points and listings, and permanent banning from the platform, without refund.

11. Intellectual Property

11.1 Your Content

You retain full ownership of all content you submit to Nonograms Club, including website descriptions, logos, screenshots, and reviews. By submitting content, you grant Nonograms Club a worldwide, non-exclusive, royalty-free, sublicensable licence to display, reproduce, and distribute your content solely as necessary to operate and promote the directory service.

This licence continues for as long as your content remains on the platform. If you remove your content or delete your account, we will cease displaying it within a reasonable timeframe, except where cached copies may persist temporarily.

11.2 Our Content

The Nonograms Club name, logo, design, source code, features, and all original content created by us are our proprietary property or the property of our licensors. You may not copy, modify, distribute, sell, or create derivative works of our content without our express written permission.

11.3 Copyright Claims

If you believe that content on Nonograms Club infringes your copyright, please contact us via the Contact page with details of the alleged infringement. We will investigate and remove infringing content where appropriate.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • The service will be uninterrupted, error-free, or available at all times.
  • The content listed in the directory is accurate, complete, or reliable.
  • Any specific SEO results, traffic increases, or Domain Rating improvements will result from being listed.
  • Backlinks will remain indexed by search engines or contribute to any particular ranking factor.
  • The platform will be free of viruses or other harmful components.

You acknowledge that you use the service at your own risk. Third-party websites linked from the directory are not under our control, and we are not responsible for their content, privacy practices, or availability.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NONOGRAMS CLUB, ITS OPERATORS, AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages arising from your use of or inability to use the service.
  • Damages arising from any content posted by third parties on the platform.
  • Damages arising from unauthorised access to or alteration of your data.

Maximum liability: In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the service exceed the amount you have actually paid to Nonograms Club in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty euros (EUR 50), whichever is greater.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Nonograms Club, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the service or any violation of these Terms.
  • Content you submit to the platform, including listings and reviews.
  • Your violation of any third-party rights, including intellectual property rights.
  • Your violation of any applicable law or regulation.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

For users located in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence, where such laws provide a higher level of protection.

Subject to the dispute resolution procedure in Section 16, any disputes arising from these Terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Germany.

16. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the service, the parties agree to the following resolution process:

  1. Good faith negotiation: The parties shall first attempt to resolve the dispute through informal good faith negotiation for a period of thirty (30) days, beginning with written notice of the dispute sent via the Contact page.
  2. Mediation: If the dispute is not resolved through negotiation, the parties agree to attempt mediation before proceeding to arbitration or litigation.
  3. Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration conducted in Germany, in accordance with applicable arbitration rules. The arbitration shall be conducted in English.

EU consumers: If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution (ODR) platform.

17. Termination

17.1 Termination by Us

We may suspend or terminate your account, at our sole discretion, if:

  • You violate these Terms or our Privacy Policy.
  • You engage in prohibited conduct as described in Section 10.
  • You submit prohibited content as described in Section 6.
  • Your account is inactive for more than 24 months.
  • We are required to do so by law.
  • We discontinue the service (with reasonable notice).

Where possible, we will provide notice and an opportunity to cure before termination, except in cases of serious violations (e.g., malware, fraud) where immediate action is required.

17.2 Termination by You

You may delete your account at any time through your account settings. Upon deletion:

  • Your profile and account data will be erased within 30 days, as described in our Privacy Policy.
  • Your listings may be removed from the directory or anonymised.
  • Points, tiers, and leaderboard positions will be forfeited.
  • Payments already made are non-refundable (see Section 7).

17.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property (Section 11), Disclaimer of Warranties (Section 12), Limitation of Liability (Section 13), Indemnification (Section 14), and Governing Law (Section 15).

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war or terrorism, pandemics, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.

If a force majeure event continues for more than 90 days, either party may terminate the affected obligations by providing written notice.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last updated" date at the top of this page.
  • For material changes, we will provide at least 30 days' advance notice via email to registered users or by posting a prominent notice on the website.
  • For minor changes (formatting, clarifications that do not affect your rights), updates take effect immediately upon posting.

Your continued use of Nonograms Club after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the service and delete your account.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nonograms Club regarding your use of the service and supersede all prior agreements, representations, and understandings. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
